Items advertised on the website may not necessarily be in stock and available for sale. Availability of any item will be confirmed during the processing of orders.

Ordering from JEWELLERY DESIGN BY NICK DOW can be achieved online using my website shopping cart, by e-mail or by snail mail. To avoid disappointment it is advised that if ordering using the shopping cart the customer use the online payment system Paypal to pay for their goods in full.
JEWELLERY DESIGN BY NICK DOW reserves the right to decline to trade with any person or organisation. In addition, and notwithstanding any other provisions of these conditions of sale, I may decline to accept any order, whether or not payment has been received, by giving notice of non-acceptance to the Customer by email, facsimile or telephone as soon as possible. In the event that I decline to accept an order in respect of which payment has been received, the full amount of such payment will be refunded.
JEWELLERY DESIGN BY NICK DOW reserves the right to deliver part orders, or hold orders until all items are available, as required. In such a case payment is taken when Goods are dispatched for delivery or collected, the only exception being for commissioned or built to order Goods. Only one mail order handling charge will be levied (if applicable) in respect of the total order unless the customer specifies a split delivery.
Back Orders
If JEWELLERY DESIGN BY NICK DOW happens to be out of an item, I will usually list it promptly on the website. If the customer has ordered an item which is out of stock I will promptly advise the customer as to an expected delivery date, advise on a similar product or refund any monies paid for the product, whichever is deemed appropriate. However, I do manufacture the majority of products myself and strive on fast production. With our repeatable products I usually have the customers items ready to ship in 5 working days. If for some reason the customers order should take longer, the customer will receive an email as to when the item will be shipped.
Payments
Payment shall be made by the Customer for all monies owed to JEWELLERY DESIGN BY NICK DOW in respect of orders placed for Goods. Payment shall be made at the time that the order is placed. Payment may be made by, and is acceptable by, cash, cheque or major credit and debit cards through Paypal: (Switch, MasterCard, Visa and American Express). Cheque's and Postal Orders must be made payable to "JEWELLERY DESIGN BY NICK DOW" and crossed "payee only".
Cash payments must be sent by recorded delivery or delivered in person upon collection of the customers order.
Please contact me direct for cheque payments and I will forward the address for payment to be sent too. Goods will be dispatched upon clearance of the cheque which can take up to 10 working day’s after receipt of the cheque.
All Credit & Debit card payments are performed using the services of Paypal. If using Paypal the customer should abide by the terms and conditions set by Paypal. Paypal payments can be made after using the online shopping cart or you can request a Paypal e-mail payment. For more information please go to www.paypal.co.uk.
Although JEWELLERY DESIGN BY NICK DOW will supply to the trade, I will not supply credit or trade accounts. All goods must be paid in full before they are dispatched.
JEWELLERY DESIGN BY NICK DOW can not be held responsible for any lost postal payments or payment frauds as a result of using Paypal.
Delivery
Orders under 1kg will be dispatched where reasonably practicable by Royal Mail Recorded Delivery. For items ordered which are in stock they will be dispatched within 5 working days of the order unless otherwise stated on the website or agreed with the customer. All orders over 1kg will be dispatched where reasonably practicable by a courier service at the buyers cost. For items ordered which are in stock they will be dispatched within 7 working day’s of the order unless otherwise stated on the website or agreed with the customer. If for any reason I cannot honour this delivery time I will contact the customer.
The Customer must inspect the Goods as soon as reasonably practicable after delivery and shall within 14 days of such delivery or receipt give notice to JEWELLERY DESIGN BY NICK DOW of any damage or defect in the Goods. Queries regarding shortages of Goods must be made within 14 days of delivery date and must be accompanied by the despatch note. Queries regarding Goods invoiced but not delivered must be made to JEWELLERY DESIGN BY NICK DOW within 14 days of invoice date and the invoice number must be quoted. If the Customer fails to give such notice, the Goods shall be conclusively presumed to be in all respects in accordance with the Contract and free from any damage or defect which would be apparent on reasonable examination and the Customer shall be deemed to have accepted the Goods accordingly. SHOULD THE CUSTOMER DECIDE TO ACCEPT A DELIVERY TO THEM IN A DAMAGED CONDITION THEY MUST ENDORSE THE CARRIERS DELIVERY DOCUMENTATION.
JEWELLERY DESIGN BY NICK DOW shall not be liable to compensate the Customer by way of damages or otherwise for non-delivery or late delivery of the Goods or any of them or for any loss consequential or otherwise arising from non-delivery or late delivery. The risk of damage to or loss of Goods ordered from JEWELLERY DESIGN BY NICK DOW will pass to the Customer when the goods are dispatched.
Delivery will normally only be made to the Customer's registered address unless notified to JEWELLERY DESIGN BY NICK DOW in writing beforehand.
Guarantee
At JEWELLERY DESIGN BY NICK DOW I take great pride in my reputation for quality and service. I want the customer to be completely happy with their purchases, and if for any reason the customer is dissatisfied with their purchase, I will be happy to help the customer with a prompt exchange or refund.
Quality Of Materials
JEWELLERY DESIGN BY NICK DOW strive to use suppliers who provide consistent product quality. However, due to the nature of natural components such as gemstones, or the individuality of the design, no two items are guaranteed to be exactly identical.
Returns
If the customer needs to return the item for any reason they should contact JEWELLERY DESIGN BY NICK DOW with the nature of the return and I will supply the customer with more detailed instruction on how to return the goods.
If there has been a mix-up with the customers order, they should notify us straight away and within 14 days. I try really hard to dispatch everything accurately, but occasionally a mistake is made. In this case, every effort is made to rectify the situation as quickly as possible.
If the item is proved to be faulty I can supply a full refund if the item is returned within 14 days of receipt. After 14 days I can only repair the item (if possible), send a replacement item (if possible) or supply shop credit.
If the customer is returning any item because it was not exactly as described on the website the customer can return the item within 7 days of receipt in the same condition as supplied (Packaging and any hygiene seals intact) for a full refund. JEWELLERY DESIGN BY NICK DOW will not refund postage & packaging or delivery fees.
If any item is damaged during delivery the customer should contact me within 14 days of receipt and I will supply the customer with proof of posting and proof of value for the customer to claim costs for the item from Royal Mail. JEWELLERY DESIGN BY NICK DOW is not responsible for items once they have been dispatched. Where applicable I will send a replacement item.
For health and safety reasons, earrings can only be returned for full refund or shop credit if the packaging and hygiene seals are unopened and intact.
Complaints
Any complaints should be e-mailed to jewellerydesignbynickdow@hotmail.co.uk and I will try to respond to the customer complaint as quickly as possible.
Force Majeure
JEWELLERY DESIGN BY NICK DOW shall not be liable to the Customer or deemed to be in breach of Contract by reason of any delay in performing, or any failure to perform, any obligations of JEWELLERY DESIGN BY NICK DOW in relation to the Goods, provided that the delay or failure was due to any cause beyond reasonable control of JEWELLERY DESIGN BY NICK DOW. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond reasonable control of JEWELLERY DESIGN BY NICK DOW: Act of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of JEWELLERY DESIGN BY NICK DOW or of a third party); illness, difficulties in obtaining raw materials, labour, fuel, parts or machinery; power failure or breakdown in machinery.
Law
All contracts between JEWELLERY DESIGN BY NICK DOW and the Customer shall be governed by and interpreted in accordance with English Law and both JEWELLERY DESIGN BY NICK DOW and the Customer submits to the exclusive jurisdiction of any competent Court in England.
Consumer Protection
Nothing contained herein shall affect a Consumers rights under the Unfair Contract Terms Act 1977 or any regulations made under it including the Unfair Terms in Consumer Contracts Regulations 1994.
